HARMONIOUS CONSTRUCTION:M.S.M SHARMA V. DR.SHREE KRISHNA SINHA AND OTHERS

In this case, the petitioner, the Editor of Searchlight, an English daily newspaper had published the portion of proceeding of the Legislative Assembly against the privilege given to the Speaker and the Assembly in Article 194(3) of our Constitution. He was called to show cause before the Committee  of the Bihar Assembly.
He moved to the court under Article 32 claiming his right to speech under Article 19(1)(a) was unreasonably restricted.
The court by harmonious construction laid down that the specific right of the Speaker is of more importance than the general right of the citizens. Thus, the restriction upon the Editor is not unreasonably restricted.
