Supreme Court: Polygamy not Integral to Islam

A legislature representative can’t take asylum under Article 25 of the Constitution managing right to maintain religion, to test principle notwithstanding polygamy, the Supreme Court held today.
The Supreme Court said the Conduct Rules of the Uttar Pradesh government for its representatives, which orders earlier consent for contracting second marriage amid the presence of the first marriage, is not violative of Article 25 of the Constitution.
The court was managing an advance recorded by a Muslim representative in UP’s Irrigation Department testing a disciplinary power request expelling him from administration for demonstrated unfortunate behavior of an alternate marriage amid the presence of the first marriage, which was maintained by Allahabad High Court.
Holding that there was no compelling reason to meddle with the High Court’s finding on “demonstrated offense”, a seat embodying judges T S Thakur and Adarsh Kumar Goel said his discord that such manage was violative of Article 25 was replied by the pinnacle court in Javed versus State of Haryana matter.
For this situation, it was held that what was secured under Article 25 was religious confidence and not a practice which may run counter to open request, wellbeing or ethical quality.
“Polygamy was not vital piece of religion and monogamy was a change inside the force of the State under Article 25. This Court maintained the perspectives of the Bombay, Gujarat and Allahabad High Courts to this impact.
In its judgment, the seat said, “as respects the charge of unfortunate behavior being referred to, it is patent that there is no material on record to demonstrate that the appealing party separated his first wife before the second marriage or he educated the Government about getting the second marriage.
“In nonappearance thereof, the second marriage is an unfortunate behavior under the Conduct Rules,” the seat said.
