New Delhi,September 10: The Supreme Court today set aside an interim order of the Delhi High Court to re-examine the victim and 12 other witnesses of the Delhi Uber cab Rape Case in which 32-year old Uber cab driver, Shiv Kumar Yadav has been accused of raping a 25-year old woman executive.
The verdict was pronounced by Justice Goel, on a petition submitted by the victim and the Delhi Police which challenged the High Court’s March 4 order of re-examination of 13 witnesses including the victim herself.
The victim, in her petition had contended that the HC order amounted to more trauma and humiliation of standing at the witness box again. The Police described this as nothing but a delaying policy by a seasoned criminal. Attorney General, Mukul Rohatgi, appearing for Delhi Police had supported the victim’s appeal against the HC order. “He(the accused) is not a novice. This accused has faced criminal trials before,” Rohatgi was quoted as saying.
The Court, while reserving its verdict had said last month that the accused cannot be allowed to frustrate trial on flimsy pleas and that unnecessary re-examination of witnesses and victim would cause nothing but mere harassment and unwanted delay of the criminal proceedings.
