New Delhi, November 30: The SC, today, dismissed a plea seeking a direction to the Central Bureau of Investigation (CBI) to register a case against Congress Vice President Rahul Gandhi for allegedly declaring himself to be a British national before company law authorities there.
A Division Bench comprising Chief Justice HL Dattu and Justice Amitava Roy questioned the authenticity of the document attached with the Public Interest Litigation (PIL) and the manner in which the papers were procured.
The Bench said that the petitioner has made baseless allegation against Rahul Gandhi without making proper verification of the facts and called the petition “frivolous.”
The Bench said that it is for the Election Commission to see if Gandhi has violated Election law.
Earlier, the Apex Court had refused urgent hearing on a plea filed by lawyer M L Sharma.
Recently, BJP leader Subramanian Swamy had accused the Congress Vice President of posing as a British national before the authorities, in connection with incorporation of a firm.
The documents released by Swamy show that Mr Gandhi had called himself “British” on the annual returns of a UK-based firm ‘Backops Limited.’ Rejecting the said allegations, the Congress had released a certificate of incorporation of the company that mentioned his nationality as Indian.
