The government is working on a proposal to amend the Code of Criminal Procedure restricting powers of the police to arrest.
Even the Supreme Court in it’s 2014 judgement found it necessary to amend the provisions relating to arrest. The concern on it was raised when the rate of conviction under Section 498-A of IPC was low.
A separate Bail Act is also under consideration that would limit the discretionary powers of the court to grant relief to the accused.
A source said that the government has shown interest in ‘restorative justice’ model where the victim may settle the disputes through courts or plea bargaining even before the police investigation is initiated.
The issue was discussed in a high-level meeting chaired by law minister, Sadananda Gowda.
The law ministry is hopeful that the Law Commission will submit recommendations on reforming the criminal justice system within six months.
