An investigation is conducted by Special Investigation Team (SIT) in order to probe the allegations put forward by a Naval Officer’s wife that her husband and his colleagues are forcing her in wife-swapping and then further torturing her for her refusal to join them. A bench headed by Chief Justice T.S.Thakur and Justices U.U.Lalit and R.Banumathi rejected the complainant’s plea for a CBI probe and stated that it is an offence which will be look after by or will be investigated by the state police.
She further contended that earlier one year after her marriage on April 4 2013, she lodged complaint against her in laws and husband for mental and physical cruelty. Along with her husband, she accused five naval officers and the wife of one of them of sexually abusing her. She also petitioned in the Apex Court for the transfer of proceedings pending before the Kerala High Court. While on September 13 Supreme Court stayed the proceedings in Kerela High Court.
Further, Supreme Court permitted the woman to make the Centre a party to her petition and issued notices to the Kerala government, the commander of Southern Naval Command, five other officers and her husband. Justice Bhanumati said that mere apprehension that the accused are influential may not be sufficient to transfer the case, so no CBI probe will be done. But since police can investigate so the Harbour Police station in Kochi had lodged an FIR on her complaint naming her husband, his family members and five naval officers.
