National Workshop on “Arrest of Ships in India: Legal Constraints & Challenges”" 20th-21st February 2015

School of Legal Studies,CUSAT is organizing a Two Day National Workshop on “Arrest of Ships in India: Legal Constraints & Challenges” on February 20th and 21st, 2015.
The arrest of ships is a significant feature of international maritime jurisdiction. Very often legitimate claims will go unsatisfied unless there is recourse to an effective and efficient system of maritime arrest. The regulatory frame work regarding arrest of ships have evolved in international and national spheres to provide a potential weapon in the hands of creditors for enforcement of their claims related to the ship or in execution proceedings or in satisfaction of judgments in actions arising out of collisions, salvage, loss of life or damage to goods and the like. Indian legal scenario relating to ship arrest appears to be vulnerable to address concerns raised by recent developments. India is not a party to the international norms governing arrest of Ships. This legislative inertia has been the focus in several recent judicial pronouncements rendered by courts in India. It is in this context School of Legal Studies is organizing a Two Day National Workshop on “Arrest of Ships in India: Legal Constraints &Challenges”.
THEMES & SUB THEMES:
The workshop attempts to draw attention and discussion in to key issues underlying the law governing arrest of ships. The issues in focus are:
1. Jurisdiction for arrest of ships
2. Arrest for enforcement of maritime claims
3. Alternate ship arrest and connected issues
4. Beneficial ownership of ships
5. Procedural aspects and bottle necks
6. Release of from arrest
7. Remedies for Wrongful arrest
8. Protection of property rights
