The Narendra Modi government on Tuesday endured a shock when the Supreme Court released its request to prevent private firms from testing the legitimacy of specific procurements of the questionable 2014 Coal Ordinance in different high courts.
A seat headed by Chief Justice H.l. Dattu, which dismisses the Center’s request looking for exchange of five petitions of private firms from different high courts to the peak court, additionally declined to stay a request of the Madhya Pradesh High Court permitting BLA Power Ltd to participate in the bartering procedure for designation of coal mines in the state.
“We are not saying anything on the benefits of the case. It is a begging to be proven wrong issue (whether BLA Power is identified with earlier allottee BLA Industries of a coal block)… We are at the phase of a between time request. In addition, you (Center) did not record any counter/answer affirmation before the (MP) high court,” the seat said while rejecting the petitions recorded by the Ministry of Coal.
The Madhya Pradesh High Court, on January 29, had permitted BLA Power Ltd to partake at present selling of two coal mines – Gotitoria (East) and Gotitoria (West) mine in Mahapani coalfields of Madhya Pradesh. BLA Industries, a sister concern of BLA Power Ltd, was dispensed these coal squares in Madhya Pradesh in June 1996, which got drop taking after the Supreme Court decision.
At the beginning, Attorney General Mukul Rohatgi, showing up for Coal Ministry, said that Jindal Power and Steel, BLA Power and Sova Ispat Ltd have recorded five different petitions in Delhi, Madhya Pradesh and Calcutta High Courts individually.
“The inquiries of law that emerge in the pending petitions are comparable and are significant inquiries testing the legitimacy of The Coal Mines (Special Provisions) Ordinance, 2014 and the legitimacy of the procurements of Standard Tender Document available to be purchased of coal pieces being held in compatibility of the judgment dated August 25, 2014 and request dated September 24, 2014 of this Court…,” he said and looked for their exchange to the zenith court. Then again, the seat in the wake of giving an hour-long hearing, declined to give any easing to the Center.
